This End-User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Dittah Inc. ("Licensor") for the software product Dittah Studio, which includes Docker images, executable code, and associated media (the "Software").
1. License Grant
Licensor hereby grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software solely for personal, non-commercial use or internal evaluation purposes, strictly in accordance with the terms of this Agreement.
2. Restrictions
You agree not to, and you will not permit others to:
- Commercial Use: Use the Software for any commercial purpose, including but not limited to providing services to third parties, internal production business workflows, or any revenue-generating activity without a separate Enterprise License.
- Reverse Engineering: Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Software.
- Redistribution: Copy, rent, lease, lend, sell, redistribute, or sublicense the Software or the Docker images.
- Modification: Modify, adapt, improve, or create derivative works from the Software.
3. Intellectual Property
The Software, including its structure, organization, code, and brand assets (including the "Di" and "Ta" mascots, the "Dittah" name, and the tagline "Build with Intelligence. Run with Confidence."), are the valuable intellectual property of Dittah Inc. and are protected by copyright and trademark laws.
4. Termination
This Agreement is effective until terminated by you or Licensor. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term(s) of this Agreement.
5. No Warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. DITTAH INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
6. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL DITTAH INC. BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.
